INDIAS LEGISLATION ON MASTURBATION
In India as there is no specific laws that criminalise or regulate masturbation among consenting adults in private settings. Also it is not mentioned as a criminal act explicitly. However, section 377 of the Indian Penal Code, which criminalized homosexuality was previously used to target individuals engaging in homosexual acts, including masturbation. In India, the act of public masturbation is deemed as a violation of public decency and morality. It is considered to be an indecent act that can lead to legal consequences. However, India has laws related to obscenity and public decency that could potentially be applied in certain contexts. Generally, Indian laws focus more on regulating public behaviour and sexual offences rather than private sexual activities such as masturbation.
Laws which are applied in this context are Public Nuisance Laws, Obscenity Laws and Outraging Modesty Laws.
• Public nuisance laws can be considered a public nuisance under section 268 of the Indian Penal Code. The case of STATE OF PUNJAB VS MAJOR SINGH in 1966 which highlighted public indecency as a form of public nuisance.
• Obscenity laws in this masturbation in public can also fall under the purview of obscenity laws in India. The case of RANJIT UDESHI VS STATE OF MAHARASHTRA in 1964 set a precedent for defining obscenity in Indian Law.
